Welcome to StaffPulse. These Terms of Service ("Terms") govern your access to and use of StaffPulse's staff scheduling and time tracking software, website, and related services (collectively, the "Service").
By using StaffPulse, you agree to these Terms. If you do not agree, please do not use our Service.
1. Account Registration
To use StaffPulse, you must:
- Be at least 18 years old or have parental/guardian consent
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
2. Subscription and Payment
Pricing
StaffPulse offers a subscription service at $10.99 per month, which includes unlimited users and locations. Prices may change with 30 days' notice.
Free Trial
New accounts receive a 14-day free trial. No credit card is required to start. After the trial, you must subscribe to continue using the Service.
Billing
- Subscriptions are billed monthly in advance
- Payments are processed through secure third-party payment providers
- You authorize us to charge your payment method automatically
- Failed payments may result in service suspension
Refunds
We offer a 30-day money-back guarantee. If you're not satisfied within the first 30 days of a paid subscription, contact us for a full refund.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Scrape, crawl, or harvest data from the Service
- Resell or redistribute the Service without authorization
- Use the Service to send spam or unsolicited communications
4. Your Data
Ownership
You retain ownership of all data you input into StaffPulse, including staff information, schedules, and time entries ("Your Data").
License to Us
You grant us a limited license to use Your Data solely to provide and improve the Service. We will not sell Your Data to third parties.
Data Export
You may export Your Data at any time through the Service. Upon account termination, we will provide a reasonable period to export Your Data.
Responsibility
You are responsible for:
- The accuracy of data you enter
- Obtaining necessary consents from staff members
- Compliance with labor laws and regulations
- Backing up Your Data regularly
5. GPS and Location Services
Our Service may collect location data for clock-in verification. You agree to:
- Inform staff members about GPS tracking
- Obtain appropriate consent where required by law
- Use location data only for legitimate business purposes
- Comply with applicable privacy laws regarding location tracking
6. Intellectual Property
StaffPulse and its original content, features, and functionality are owned by StaffPulse Ltd and are protected by international copyright, trademark, and other intellectual property laws.
7. Third-Party Services
The Service may integrate with third-party services. We are not responsible for the availability, accuracy, or content of such services. Your use of third-party services is subject to their terms and policies.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may:
- Perform scheduled maintenance with advance notice
- Make emergency changes to protect the Service
- Modify or discontinue features with reasonable notice
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the past 12 months
- We are not liable for data loss; maintain your own backups
10. Indemnification
You agree to indemnify and hold harmless StaffPulse and its affiliates from any claims arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.
11. Termination
By You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your billing period.
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay subscription fees
- Engage in fraudulent or harmful activities
12. Dispute Resolution
Any disputes arising from these Terms or the Service will be resolved through:
- Good-faith negotiation between the parties
- Mediation if negotiation fails
- Binding arbitration as a last resort
13. Governing Law
These Terms are governed by the laws of Ireland, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts in Dublin, Ireland.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and StaffPulse
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- Waiver: Failure to enforce any right does not constitute a waiver
- Assignment: You may not assign your rights without our consent
